Terms of Service

These Terms of Service ("Terms") govern your use of the Twistik mobile application ("the App"), published by the provider named in the Impressum, based in Germany. They apply to the Twistik apps on both Android and iOS.
1. Acceptance of Terms
By installing or using the App, you agree to be bound by these Terms. If you do not agree, please uninstall the App.
2. Description of Service
Twistik is a free tongue twister practice app. It provides tongue twisters in multiple languages for personal, non-commercial use. The core practice features (browsing twisters, favorites, mastered list, challenge mode, preferences) work entirely on your device and do not require an internet connection. An optional in-app voice-recording feature lets you record yourself practicing a twister, with playback, multi-recording management, and bulk-delete tools, all stored entirely on your device (see Privacy Policy §2 and §4). When your device is online and only if you have given your consent, the App may send anonymised crash reports and basic app-usage events to Google's Firebase service for debugging and version-adoption tracking; this telemetry is off by default — see Privacy Policy §6 for details and the consent it requires. If you tap Rate this app (or accept the optional in-app rating prompt), the App invokes your platform's in-app review flow; see Privacy Policy §8.
The App is free to download and use, and all practice features are free. The App additionally offers optional one-time, consumable in-app purchases ("tips") through which you may voluntarily support development. Tips unlock no features or content; you are never required to buy anything. Purchases are processed by Google Play (Android) or the App Store (iOS) acting as seller of record; the associated data flow is described in Privacy Policy §7. A tip is digital content that is supplied immediately. When you confirm a tip you expressly agree that performance begins at once and you acknowledge that you thereby lose your statutory 14-day right of withdrawal pursuant to § 356 (5) BGB. Refunds and chargebacks are handled by Google or Apple under their respective store policies.
3. Content
The tongue twister content provided in the App comes from two sources:
- Traditional tongue twisters: curated from the public domain and cultural heritage of their respective languages. These are not claimed as original works.
- AI-generated tongue twisters: some content (particularly in Japanese) was generated using artificial intelligence (Claude by Anthropic) following structured linguistic templates derived from traditional patterns. This AI-generated content has been reviewed for quality but may contain imperfections.
While we strive for accuracy, we make no guarantees regarding the linguistic correctness or completeness of the content across all supported languages.
4. Your Recordings
If you use the in-app voice-recording feature, the audio you record belongs to you. We do not claim any ownership, license, or other rights over your recordings. They are stored entirely on your device, so we never receive a copy and have no way to access them. You can delete recordings at any time via Settings → Manage recordings or Settings → Reset App Data.
5. Intellectual Property
The App's design, code, and curated/generated content are protected by copyright. You may not:
- Reverse-engineer, decompile, or disassemble the App, except to the extent expressly permitted by mandatory applicable law (including Art. 6 of Directive 2009/24/EC on the legal protection of computer programs).
- Extract, reproduce, or redistribute the tongue twister content in bulk.
- Use the App's name, logo, or branding for any purpose without prior written consent.
6. User Responsibilities
You are responsible for your device and any data stored by the App on it. The App stores data locally (favorites, mastered twisters, voice recordings, preferences); this data is under your control. You are also responsible for the content of any voice recordings you make using the App, including ensuring that recording yourself or anyone in earshot is lawful and consensual under applicable law.
7. Warranties
The App is provided free of charge for use "as is" and "as available". We do not warrant that the App will be error-free or uninterrupted. Your statutory rights as a consumer — in particular any warranty rights in respect of paid in-app purchases — remain unaffected by this clause.
8. Liability
We are liable without limitation:
- for damages arising from injury to life, body or health that result from a negligent or intentional breach of duty by us or our legal representatives or vicarious agents;
- for damages caused by our intent or gross negligence;
- to the extent we have assumed a guarantee; and
- under the mandatory provisions of the German Product Liability Act (Produkthaftungsgesetz).
For damages caused by slight (simple) negligence, we are liable only where we breach an essential contractual obligation (a "cardinal duty" — an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely). In that case our liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded. The above limitations also apply in favour of our legal representatives, employees and vicarious agents. They do not affect any mandatory statutory liability or your mandatory consumer rights.
9. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another country, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence (Art. 6 Rome I Regulation). Likewise, as a consumer you may bring proceedings, and may only be sued, in the courts designated by the mandatory consumer-jurisdiction rules that apply to you.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes within the App before they take effect. Updated Terms will be included in future App updates and published here. If you do not agree to the revised Terms, you may stop using the App. Continued use after the effective date of a change constitutes acceptance of the revised Terms.
10a. Online Dispute Resolution
